JAKARTA (TheInsiderStories) – The heirs of former president (late) Soeharto could be caught by surprised after the Supreme Court accepts a judicial review on lawsuit filed against the former President and Supersemar Foundation over irregularities of the use funds by Supersemar Foundation. The Supreme Court orders the heirs of Soeharto to pay Rp3.39 trillion over Supersemar foundation lawsuit
The Supreme Court penalizes the heirs of Soeharto and Supersemar Foundation to pay $315 million and Rp139.2 billion, or a total of Rp4.39 trillion ($1=13,500).
The verdict on the judicial review was decided by panel of Supreme Court judges, namely Suwardi (judge chairman), Soltoni Mohdally and Mahdi Soroinda. The lawsuit against the Supersemar foundation was filed by the government.
It may not be the heirs of late Soeharto who are caught by the surprise, but also the general public. The lawsuit on Supersemar Foundation as well as other foundations of the former first family have been conducted in the past but the verdicts were most often disappointed the public.
In 2010, the Supreme Court issued verdict that the Supersemar Foundation has acted against the law. The panel of judges of at that time – Harifin A. Tumpa (chairman), rehngena Purba and Dirwoto penalized the former first family of US$315 million and Rp138.2 billion.
The verdict could not be executed as there was mistype. Instead of Rp138.2 billion, the verdict document was written Rp139.2 million.
Junior Attorney for special criminals Widyopramono said the verdict will be immediately executed.
The lawsuit was filed on the grounds that Soeharto and Supersemar Foundation misused the funds generated from the public and the government. The funds were supposed to offer scholarship to Indonesian students. The Supersemar Foundation Funds, instead, was extended to PT Bank Duta worth US$420 million. The bank was later collapsed.
The foundation also gave its money to PT Sempati Air (Rp13.173 billion) which later collapsed, PT Kiani Lestari and Kiani Sakti rp150 billion. Sempati was owned by Tommy Soeharto, youngest son of Soeharto.
On March 27, 2008, the South Jakarta District court issued verdict that Supersemar Foundation has misused the foundation’s funds. The decision was confirmed by DKI Jakarta High Court.
After the monetary and political crisis that led the demise of former president Soeharto, the children of Soeharto tried to hide away from the public sphere. However, the heirs of the former president slowly returned to public sphere. The children of the late president have managed to recover their businesses. Tommy Soeharto, as a case in point, is now expanding his hotel business as well as tanker vessel company. Bambang Trihatmodjo, Soeharto’s eldest son, has lost its media business to Hary Tanosoedibyo but still has stakes in a number of companies. Siti Hardiyanti Rukmana, Soeharto’s eldest children, is rebuilding her empire. She was embroiled in a long battle with Hary Taoesoedibyo to get back TPI, a private television. (*)
