JAKARTA (TheInsiderStories) - Minister for Communication and Information (Kemenkofinfo) will launch Ministerial Decree (Permen) on Safe Harbour Policy to support the Stipulation Letter (SE) of the ministry issued earlier No. 5/2016, aiming at protecting the e-commerce industry from manipulation by irresponsible merchants. The ministry hopes to issue the decree this year.
Minister for Communication and Information Rudiantara said that today the e-commerce platform is prone to manipulation by irresponsible merchant or e-commerce users that leads to legal cases. The ruling, he said, will protect e-commerce players that are in early stage development or growth.
“The target is that it will be completed this year, just wait. We now use stipulation, we will see how it goes,” he said in Jakarta on Monday (Feb 27).
He said his ministry will not harshly issue the ministerial decree as the internet and e-commerce industry is a dynamic industry, therefore the ministry needs to monitor the progress and situation before issuing the ministerial decree (Permen).
He noted that the decree will be more or less similar to the existing SE Menkominfo No. 5/2016 on Limitation and Responsibilities of E-Commerce operator and Merchants as well as Trade system through electronic mechanism in the form of User Generate Content, known as Safe Harbour Policy or Digital Millenium Copyright Act (DMCA). The decree, he said, will become a strong legal foundation for all e-commerce players. (*)
